01 · The brief
CRA DisapprovalWhat this resolution actually does

This resolution uses the Congressional Review Act to overturn an EPA decision that granted California a waiver to set greenhouse gas standards for new motor vehicles. It says the named waiver rule shall have no force or effect. Under the CRA, passing such a disapproval also prevents the agency from issuing a substantially similar rule in the future unless Congress enacts new legislation. The CRA is an expedited procedure Congress can use to nullify recent agency rules.

Rule targeted

California State Motor Vehicle Pollution Control Standards; Notice of Decision Granting a Waiver of Clean Air Act Preemption for California's 2009 and Subsequent Model Year Greenhouse Gas Emission Standards for New Motor Vehicles (74 Fed. Reg. 32744 (July 8, 2009)).

Issuing agency

Environmental Protection Agency (EPA)

Passage rules

Under the Congressional Review Act, disapproval resolutions are handled through an expedited Senate process that prevents filibusters and requires only a simple majority there. As a joint resolution, it still must be passed by both the House and Senate and be presented to the President for signature or possible veto.

This joint resolution would, under the Congressional Review Act (chapter 8, title 5), disapprove and nullify the EPA rule (74 Fed.

Reg. 32744, July 8, 2009) that granted California a waiver under the Clean Air Act for its 2009 and subsequent model year greenhouse gas emission standards for new motor vehicles.

If enacted, the rule "shall have no force or effect."

Passage30/100

Narrow but ideologically charged; success needs both chambers and executive concurrence; legal/timing and stakeholder obstacles increase difficulty.

CredibilityAligned

Relative to its intended legislative type, this bill performs the core, narrow function of a Congressional Review Act disapproval resolution: it names a specific agency action and declares that the action shall have no force or effect. It is concise and legally targeted but terse.
