What’s at stake isn’t just $5 billion—it’s whether a president can rip away Congress’s most important power: the power of the purse.
A “pocket rescission” is when the President tries to run out the clock and let the money expire.
The Government Accountability Office has already said this is ILLEGAL. The Supreme Court has ruled that Presidents CANNOT cancel parts of laws on their own.
When Congress passes a budget, the President MUST spend the money as written.
If the President wants to cancel funds, he has to ASK Congress. If Congress says no or does nothing, the law says the money must be spent.
Trump’s budget director, Russell Vought, is trying to cancel about $5 BILLION in funding that Congress already approved using a scheme called “pocket rescission.”
