When the Supreme Court does its worst democracy-damaging work for the Republican Party and its billionaire backers, always look for false facts, developed in the Court’s secret, unreviewable, private deliberations.
In Citizens United, it was the false factfinding that the unleashed funding would be transparent, and the corrupting flood of dark money we’ve seen would not happen. The Court persists in that plain, clear error of fact, despite the dark money billions.
In Shelby County, it was the false factfinding that things had changed such that the Voting Rights protection at issue was no longer necessary, even though Congress had found the exact opposite facts after a lengthy, bicameral, bipartisan process.
In Rucho, it was the false fact-finding that courts weren’t able to deal with the gerrymandering question, when in fact court after court — federal and state — had successfully resolved gerrymandering challenges.
The Republican plan was called RedMap and the Court greenlighted it. Like other anti-democratic Court decisions, this one stood on false facts. False fact-finding is a plague in this Court’s most anti-democracy decisions.
More and more people are noticing. In Texas, concern is at 92% as they get bombed by floods, hail, and wildfires.
Trump wants you to believe the recent uptick in Epstein stories is some calculated hoax, but their creepy relationship is far from breaking news.

Unless you see all the pieces of this sordid saga, it’s hard to understand how the Judicial Conference proceedings are being set up to spare DOJ having to answer questions under oath in Judge Boasberg’s contempt proceedings.
The very same DOJ that will eventually be the subject of contempt proceedings will likely now seek to disqualify Judge Boasberg, based on the invented ethics complaint and the “created conflict” coming from the Chief Justice’s Judicial Conference.
On its face, the ethics complaint seems hogwash. But for DOJ, it tees up a challenge to Boasberg going forward with the contempt hearing whenever the stay is lifted. The lawyers’ term for that is “creating a conflict.”
(As a sidebar, the allegation is that Boasberg spoke generally about violation of court orders by the Trump administration. If that’s the complaint, in addition to being private, in an internal administrative venue not a judicial one, it has the benefit of being true.)
